Introduction

Welcome to the 4shared free online file sharing service, which is operated by the pmStation Company.

Please read these terms of use carefully before using this 4shared service. By using the 4shared service, you, the User, signify your agreement to these terms of use. If you do not agree to these terms of use, you may not use the 4shared service. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these terms of use at any time.

Any such change, modification, addition, or deletion takes effect after five (5) calendar days following our posting of such notice on this web site.

House Rules

By using the 4shared service, you agree not to do any of the following:

• Post, distribute, or otherwise make available or transmit any data, message, text, computer file, or other material that infringes any right of a third party and/or any domestic or international law, rule, or regulation, including but not limited to:
  • copyright, trademark, patent, or other proprietary rights;
  • right of privacy or publicity;
  • any confidentiality obligation.
• Post, distribute, or otherwise make available or transmit any software or other computer files that contain a virus or other harmful component.
• Post, distribute, or otherwise make available or transmit any pornographic and illegal materials.
• Publish or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, or racially or ethnically derogatory content, or any content expressing hate towards any person or groups of persons due to race, religion, colour, creed, national origin or sexual orientation.

PLEASE NOTE: You have to log in your free account at least once per 30 days. Otherwise, your free account and all your files will be automatically deleted! In this case, lost information can not be restored. Please, don't forget to visit your account every 30 days.

Acceptable Use

4shared is an Online File Sharing Service pursuant to Digital Millenium Copyright Act ("DMCA"). Moreover to fight against piracy we collaborate with other companies like Microsoft Corporation, Recording Industry Association of America (RIAA), Moscow Government Committee on Security, Linotype GmbH, Visual CertExam Software, Warner Music Brasil, Bondware, DAZ Productions, iMusica, Leisure Arts, Wichelt Imports and many others.

The 4shared service provides accounts for storing only legal data. If you are reported to store copyrighted or illegal materials, your account will be deactivated and you will need to perform a bureaucracy procedure to have it activated again. Moreover, in case of breaking this rules, the owner of the copyright or other intellectual property rights will be informed and may call you to account for violating their rights.

Though, 4shared doesn't take the obligation to check the account contents, but we reserve the right, at our discretion, to audit any materials that are suspected in breaking the 4shared terms of use, remove content, disable or remove the accounts of users who infringe the intellectual property rights of others or may expose 4shared to civil or criminal liability.

4shared declines all responsibility for the contents of the materials stored by 4shared users. Each and every user of 4shared is solely responsible for all materials uploaded to his account.

Please, do not store the pornography and other forbidden materials! The confirmed infringer will be reported to the appropriate legal authority. If you do not want to have big troubles you should not upload any kind of illegal materials. The identification won't be difficult - your ISP will be informed as well. Most ISPs apply a penalty actions to the clients that break their agreement by delivering the pornography etc. So it is for sure you will get a serious punishment.

You acknowledge that the 4shared Service may contain features enabling users to transmit various types of communications to other Users, and further acknowledge and agree that you shall not use neither the 4shared Service nor any links to shared files or folders on 4shared to engage in spamming and junk mail. So if your campaigns receive an unreasonable amount of spam/abuse complaints, we reserve the right to shut down your account.

Disclaimer

All services in the 4shared site are provided "As is" and without warranties of any kind. We disclaim all warranties, whether express or implied, including the warranties that the site and content are free of defects, virus free, and able to operate on an uninterrupted basis, that they will meet your requirements, or that errors will be corrected, and the implied warranties that the site and content are merchantable, of satisfactory quality, accurate, fit for a particular purpose or need, or non-infringing, unless such implied warranties are legally incapable of exclusion. Your use 4shared is solely at your own risk.

We are not responsible for any losses or damages that may have caused by using 4shared services.

We reserve the rights to remove or replace any uploaded files that are unlawful, that may compromise the security of the servers, that are using excessive bandwidth, or when deemed necessary without prior notice.

Forum

Forum is a chat area or message board offered as one of 4shared services. If you participate in it, you agree to follow our terms set below: If you use Forum for public and not private communications, please keep in mind that your personal information can be collected and used by people you do not know. We cannot guarantee the security of any information you disclose online, therefore, you make such disclosures at your own risk. You, but not 4shared, are responsible for the content of your messages in the Forum. We reserve the right to remove or edit content from any Forum at any time and for any reason. Information obtained in the Forum from its participants may not be reliable, therefore, it is not a good idea to take any action, such as making any trading or investment decisions, based largely on information you cannot confirm. We are not responsible for the content and accuracy of any information, and are not responsible for any trading, investment, or any other decisions made based on such information.

The 4shared site may contain links to third-party web sites. Those sites are independently managed and maintained by such third-party companies or individuals. We do not control those linked sites.
